Abstract: 

Information in the form of text messages and email is not secure. This becomes problematic when a victim’s emails or text messages become part of the offender’s defense. This article summarizes some recent cases where victims’ private communications were used in court cases. Restrictions protecting privacy rights have been loosened recently in the interest of national security. With regards to victims, the National Institute of Justice has issued guidelines regarding the use of digital evidence, and how it can be obtained. The author summarizes these guidelines and how they apply to victims in court cases.
