Abstract:

In a sick inversion of justice, battered women are often charged with crimes based on false allegations or other trumped-up charges lodged by their abuser, while the abuser gets away with his machinations and remains free to continue his abuse and exploitation of the survivor. In this article, adapted from their book “Representing the DV Survivor,” authors Barry Goldstein and Elizabeth Liu paint a detailed picture of the legal landscape faced by DV survivors who face criminal charges. The authors, themselves experienced DV attorneys, provide a roster of suggestions for counteracting such charges, which can be especially lethal to the survivor’s child custody case.
