Abstract:
This article examines the implications of—and law firm reaction to—an opinion by a Committee of the New Jersey Supreme Court on the Unauthorized Practice of the Law that the activities and role of bond counsel constitute the practice of law, that the provision of bond counsel services to New Jersey governmental bodies constitutes the practice of law in New Jersey even where the services are performed entirely outside the boundaries of that state, that all attorneys practicing law in New Jersey be licensed and maintain a bona fide office in New Jersey, and that, therefore, an attorney who provides bond counsel services to New Jersey governmental bodies without having been licensed to practice law and without a bona fide office in New Jersey engages in the unauthorized practice of law.Keywords: NABL Code of Professional Responsibility; Rules of Professional Conduct
