Abstract:

Tax counsel, like other areas of legal practice, is susceptible to significant change on a regular basis; whether by stroke of the legislative pen or by seminal court decisions, tax rulings, private letter rulings (PLRs), and technical advisory memoranda (TAMs). To best advise our clients we also have to respond to client-specific personal, family, health, and financial changes. Socially, we are in the midst of an undeniable culture shift as our population ages. As professional advisors, whenever such changes occur change brings new challenges and new opportunities. This article examines ten developments affecting the practice of elder law. The objective is to help tax counsel become more aware of this social phenomena and the broad impact it is having on almost every area of legal practice.
