Abstract:

Recently tension has arisen between the U.S. Patent and Trademark Office (USPTO) and the IRS, two influential government agencies that rarely interact. The controversy involves the issuance of patents on tax strategies. According to a recent news release by the American Institute of Certified Public Accountants, as of May 18, 2007 the USPTO has awarded 60 patents related to tax strategies, with an additional 86 applications pending. The practice of patenting tax strategies concerns not only the AICPA and the IRS, but a number of other professional groups for many reasons, and rightly so.
