Hague Convention Article 13(b) Guide to Good Practice: Addendum to Weiner’s Commentary

Abstract:
In a recent issue of Domestic Violence Report (October/November 2019), the author described the much-anticipated “Article 13(b) Guide to Good Practice” that the Hague Conference on Private International Law was planning to release. Although the author had misgivings about obvious shortcomings in the draft release under review, the article expressed hope that some of these would be addressed before a final version was issued, and that the end product would be useful to advocates. This article, which is designed to be read in conjunction with the original (“The Article 13(b) Guide to Good Practice”), updates the author’s analysis, based on the final published document, and in light of the Supreme Court’s decision in Monasky v.
