Abstract: 

While it’s a crime to beat your wife in New York State, in the Second Department, the largest of New York State’s four intermediate appellate court districts, it is not a crime to destroy her property. In People v. Person, a conviction of criminal mischief was reversed because the defendant had an equitable interest in the property destroyed.
