Abstract:
Part I of this article, in the previous issue of VED, dealt with some of the nursing home quality issues addressed by PPACA, the health care reform bill. This article covers civil money penalty (CMP) issues, information reporting requirements, and some of the types of insurance fraud and other financial abuses that have already been reported in the wake of PPACA’s enactment. March 2011 is the deadline for adding information to NHC dealing with adjudicated criminal violations in the facility (defined as abuse, neglect, exploitation, criminal sexual abuse, and any other crime resulting in serious bodily injury). Civil monetary penalties against the facility and its employees will also be listed on NHC. By March 2012, HHS must have a new data collection and reporting system in place to allow consumers to easily determine a facility’s staffing level.Keywords: health care reform bill; PPACA; National Health Care; NHC; civil monetary penalties; CMP
