Abstract:
This article reviews two legal proceedings. Mashaney v. Call, 2010 U.S. Dist. LEXIS 137319 (D. Kan. Dec. 29, 2010) Jason Mashaney, an inmate at El Dorado Correctional Facility alleged that his rights were violated when a magazine that contained sexually explicit material was confiscated from him. The US District Court for the District of Kansas granted a motion for summary judgment in favor of the defendants. In Mickens-Thomas v. Vaughn, 2011 U.S. App. LEXIS 1318 (3d Cir. Jan. 20, 2011), a prisoner was denied parole based on ex post facto conditions for eligibility. The 3rd circuit court ruled against this and ordered the Parole Board to release him “forthwith.”Keywords: sexually explicit materials; ex post facto conditions
