Abstract: 

Twenty-five-year-old Gabriel Strickland was spotted walking on a Nevada road with what was initially thought to be a shotgun. When confronted by police Strickland told them the “weapon” was a BB gun constructed with plastic and a visible orange tip. Strickland had been released from a local jail one day before a consortium of police encountered him and ended up shooting and killing this SMI person, homeless but not dangerous. In Estate of Strickland v. Nevada Co, California, 2021 WL 4443106 (E.D. Calif.), decedent’s estate brought suit for damages emphasizing the knowledge of Strickland’s mental impairment and the likelihood that he was unable to comprehend the officers’ commands.
