Abstract:

Deputies at the County Jail in Monterey heard screaming from inmate Dunham’s cell; he appeared to be having a mental crisis. For his own safety, the deputies decided to move Dunham to a safety cell. When Dunham was uncooperative and belligerent, 5 officers were called to restrain the inmate: in the process, they forced him to the ground, punched him repeatedly, tased him, kneed him in the back, and finally pinned him to the floor by the neck, where he died, asphyxiated. Defendants’ motion for summary judgment is denied, as we explain why.
