Abstract: 

Balla v. Idaho began in 1981, and over the years the federal courts have ordered relief in the areas of food preparation, medical facilities, safety, clothing, rehabilitative programming, and staffing. The parties in the suit agreed to a set of Modified Compliance Plans (MCP), requiring that the system’s facilities meeting standards for certification from the National Commission on Correctional Health, which it did in 2017. Inmates continued to find problems with the Idaho system, and the court recently concluded a two-week trial in order to determine whether any outstanding constitutional violations remained. In this article, we review the court’s decision to grant the state of Idaho’s request for termination of the long-standing relief order.
