Abstract: 

A district court’s entry of summary judgment is upheld in Smith v. Harris Co. Texas, 956 F.3d 311 (5th Cir. 2020). Unlike the Sanchez case above, Danarian Hawkins’ mother fails to win an opportunity to obtain compensatory damages via an ADA approach. This meant that while Hawkins clearly was a threat to commit suicide any derelictions of custodial preventive duties had to be shown as intentional under ADA law.
