Abstract:

Bernie Ebbers is now age 72 and has served more than 13 years imprisonment. He is the former CEO of WorldCom, Inc., and the securities fraud of which he was convicted caused shareholders and employees considerable harm. Life altering changes to fraud victims’ lives were noted in USA v. Ebbers, 2020 WL 91399 (S. D. New York). This decision deals with Ebbers’ motion for compassionate release under the much heralded First Step Act of 2018. Ebbers was denied compassionate release in 2009; in the 2019 decision, the court ruled that Ebbers be released, under release guidelines established by the First Step Act.
