Abstract:

In Leinenbach v. Washington Co., Oregon, 2018 WL 6531646 (D. Ore.) plaintiff Leinenbach brought an employment action against his county employer for alleged disability discrimination and retaliation under Title 1 of the Americans with Disability Act. The facts in this case have a particular value in illustrating issues related to the job stress, if not PTSD, experienced by many correctional officers, and the lack of any systematic, available health care for such employees. It is interesting to consider whether the clinical contacts for the Deputy Leinenbach as his emotional condition deteriorated appear to be related to conditions of employment as opposed to dealing with the mental health as independent issues.
