Abstract: 

Plaintiff is an 18-year-old former student at Parkland, Florida’s Stoneman Douglas High School. On February 14, 2018, Nicholas Cruz, plaintiff’s brother, murdered seventeen Stoneman Douglas students. On March 19, 2018, plaintiff was discovered skateboarding without permission on school grounds after the dismissal of students. Plaintiff made no threats; did not approach anyone; did not act in an odd manner and used no force to enter school grounds. He was cooperative with the arresting deputy and arrested only after his identity was learned. His misdemeanor trespass bond was set at $25 and was paid by 9:54 PM. When Cruz attempted to leave the jail, however, Captain Green ultimately refused to release him relying, apparently on a note from a nurse, that his release “has the entire community at unease.”
