Abstract: 

In Kulpa v. Cantea, 2017 WL 3888000 (6th Cir.) the Sixth Circuit reversed a district court’s summary judgment for defendants. The ruling precedent is Kingsley v. Hendrickson, 135 S.Ct. 2466 (2015). The 6th Circuit ruled that a jury could find that the defendants knew Kulpa was mentally ill, engaged in odd behavior, and officers opined he was detoxing. Six officers ringed the incoherent 63-year-old and the 300-pound Cantea delivered the final excessively lethal pressure leading to death from asphyxiation.
