Abstract:
Herve Gilles was 48 years old when he was shot and killed by a Spring Valley, New York police officer. Erratic behavior escalates into a continuing violent struggle with the decedent apparently in possession of the officer's baton and ultimately ends in a split-second decision of deadly force. This case reviews whether the officer had probable cause to believe the suspect posed a significant threat of serious harm or death to himself or others.Keywords: Elias v.
