Abstract: 

There is some confusion in the opinion on the use of force issues: This article explores question of whether an emergency, no “due process,” forcible injection was justified and, if it was, was there excessive force used in accomplishing the injection. In Spaulding v. Poitier , 548 Fed. Appx. 587 (11th Cir. 2013), the court upheld the summary judgment against the plaintiff in his claim for damages regarding the forcible administration of a disputed drug and the allegedly unconstitutional care subsequent to the injection.
