Abstract: 

In Fricano v. Lane Co., Oregon, 2018 WL 2770643 (D. Ore.) we encounter virtually text book perfect judicial handling of a jail mental health case, and in providing guidelines for jail officials to avoid causing needless harm and inviting substantial liability. Failure to timely screen incoming detainees, as here, to provide ameliorative care beyond monitoring, transfer as needed or properly house detainees with mental health conditions allows a jury to find an underlying (albeit collective) basis for deliberate indifference. Fricano has credible evidence of pre-booking failures; inadequate care, and inadequate staffing and supervision of staff.
