Abstract: 

A young cadet with the Alabama Department of Corrections (DOC) was convicted of assaulting an inmate with whom he had an earlier encounter. The inmate was cuffed and celled at the time of the assault. In sentencing the cadet, Judge Myron Thomson’s written opinion explains downward variance from the now advisory-only U.S. Sentencing Guidelines. While acknowledging the seriousness of the crime, Judge Thomson found considerable fault with the state’s failure to adequately train and supervise the C.O. We examine Judge Thomson’s wise and prudent ruling.
