Abstract: 

In August 2003, U.S. Supreme Court Justice Anthony Kennedy called on the American Bar Association (ABA) to find a better way to reduce the growth of incarceration. ABA president Dennis Archer formed a commission referred to as the Justice Kennedy Commission. Its job was to take an in-depth look at the problem and make recommendations. On June 23, 2004, Justice Kennedy publicly endorsed the proposals made by the ABA to return more sentencing discretion to judges and give them more alternatives to long prison sentences. A boxed sidebar outlines Recommendations presented to Supreme Court Justice Anthony M. Kennedy. Also included are interviews with Matthew G. Yeager. Author of “Survey of Client Specific Planning Programs and Their Feasibility as an Alternative to Incarceration in Canada”; Joe Russo, Manager of Corrections Outreach Programs for NLECTC (National Law Enforcement and Corrections Technology Center); and Dennis Doffing, currently the CEO of Metro-Trak, a manufacturer and provider of EM equipment in Minneapolis, Minnesota.
