Texting While Driving Now Primary Offense in New York

Abstract: 

In June 2011, the New York State Legislature passed legislation making texting while driving a primary offense. Governor Andrew Cuomo, who stated, “You look down for one second, and it is unforgiving,” signed the bill into law on July 12, 2011. The maximum fine remains $150, but previously the fine could only be imposed if the officer spotted the driver committing another violation; now, the use of the device is enough to be pulled over and issued a summons. The two-point penalty on a driver’s license also remains.
