New York’s New Felony Vehicular Homicide Statute

Abstract:
The Aggravated Vehicular Homicide statute arose in New York State after a series of horrific fatalities. Since 2005 New York has gotten tough on drunk drivers who kill with a series of legislative initiatives. However, a recent New York State court decision, People v. Feingold, threatens to undermine tougher sentences for impaired drivers who kill. The author examines enhanced felony drunk driving statutes in New York State.Keywords: People v. Gomez; People v.
