Abstract:
This winter, the IDU Milepost section examined the challenge to the Intoxilyzer ™ 5000 from CMI, Inc. Now, in the Florida Keys, County Judge Reagan Ptomey ordered evidence from the Intoxilyzer™ 5000 thrown out. The decision has stopped drunk driving prosecution. The Monroe County Sheriff has four Intoxilyzers™. (www.keysnews.com) The challenge has spread to New Jersey and New York. It is expected the source code defense will be used nationwide to challenge the Intoxilyzer ™ 5000 (and other units such as the Draeger).
