Abstract:
Our regular quarterly review of enacted and introduced legislation from around the country, with specific citations to statutes. At the federal level, HR 4179, which would clarify conditions under which states that had legalized medical or other marijuana use could quality for federal highway aid; at the state level, states limited the ability of police officers to download information from a telecommunications device without the owner\'s consent (Indiana); invested in awareness campaigns (Iowa) and stiffened penalties (Maryland, South Dakota, Utah, Wisconsin,) for distracted driving; and revised or adjusted impairment definitions. A number of states, including Indiana, Louisiana, Mississippi, and Utah, enacted significant changes in their impaired driving statutes, generally to broaden the definition of impairments or increase sanctions.Keywords: Distracted Driving; wireless communication devices; texting; Impaired Driving; Ignition interlock; license suspension and revocation; implied consent statute
