Abstract: 

The most significant change in the reality of sexual violence in the last 10 years has been a reformulation of the definitions used to proscribe sexually violative behaviors in society. More accurately, this decade has witnessed a retreat from the legislative baggage that has been tacked onto statutory definitions of rape and sexual assault over many decades, in deference to a re-emergence and modernization of the common law definitions of these crimes. This article looks at the shift to the consent concept of common law and the essential elements of it.
