Abstract: 

Student development theory commonly holds that the campus conduct process should be educational to assist students in their ethical development. From policies and procedures to sanctions, the conduct process is intended not to be punitive, but rather to function as a learning experience that provokes students to reflect on their behaviors, their values, and how their behavior affects other members of the campus community. This article addresses the burden of proof resting upon the complaintant and the complications that arise, especially due to the absence of the respondent’s presumed innocence and right to remain silent.
