Abstract:

The issue of search and seizure on a college campus inhabits a gray area in law. The process of searching a student’s residence hall room, after establishing probable cause, can raise questions about violations of the student’s rights. This article will explore three distinct areas. The first will offer some definitions of terms used within the arena of search and seizure. The second will consist of some case law that has been decided on this issue. The last component will address some concerns and opinions that can be raised by the institution itself.
