Abstract: 

The rights of transgender students to athletic opportunities under Title IX have not been settled by either the Supreme Court or the circuit courts of appeal. The NCAA however has issued detailed guidelines that attempt to balance the needs of transgender athletes with the need for fair competition. This article examines the wide range of issues that led the NCAA to publish the guidelines, including the fear that some FTM athletes might gain a competitive advantage by testosterone treatment; the impact of transgender inclusion on mixed team sports; the role of athletic administrators in enforcing non-harassment and non-discrimination policies; taunting; privacy and travel; and implications for compliance with the Family Educational Records and Privacy Act (FERPA).
