Abstract:
A New York appellate court upheld a lower court ruling that Sigma Pi fraternity was not liable for injuries to a Cornell student who had arrived at a fraternity party already intoxicated, been served alcohol which he did not consume, was removed from the premises for abusive behavior, and was subsequently injured in a knife fight at another location. The fraternity was absolved of any liability. Keywords: Holiday v. Poffenbarger
