Abstract:

This article analyzes the findings of the White House Task Force to Protect Students From Sexual Assault entitled “Not Alone.” One of the most difficult issues the Task Force attempted to resolve—and one it was unable to settle conclusively—was determining how best to investigate and adjudicate sexual assaults involving students (i.e., who should gather the evidence, who should make the determination whether a sexual assault occurred, who should decide the sanction, and what appeal process should be used).
