Study Abroad Tort Liability: Risk vs. Reward

Abstract:
Along with the benefits that come from studying different cultures, analyzing diverse economic systems, and experiencing life outside the United States, study abroad brings increased risk of litigation to U.S. institutions of higher education, because of unanticipated situations. Although the number of claims involving study abroad programs is small, fears of terrorism, injury, negligence, and conflict are requiring colleges and universities to develop risk strategies designed to mitigate potential liability. This article reviews some of the emerging risks faced by students studying abroad, surveys important court decisions in this area, and outlines strategies institutions are employing to manage that risk.Keywords: Fay v.
