Abstract:
Charles J. Agster, III, died in 2001 while in custody in the Maricopa County Jail, Arizona. He was arrested on August 6, and he developed respiratory difficulties after being placed in a restraint chair at the jail. The efforts made to resuscitate him were unsuccessful and he was transported to a local hospital, where he had to be placed on life support. Agster was declared dead three days later. James Fitzgerald, was an insulin-dependent diabetic with a history of low blood sugar, seizures, and a susceptibility to bone fractures because of his condition. He alleged that he told the “jail staff” of all this when he was admitted to the David Moss Criminal Justice Center.Keywords: Jaffee v.
