Abstract:

Constitutionally Adequate Medical Care for Pregnant Inmates: Michelle Goebert, a prisoner incarcerated at the Lee County Jail in Florida, gave birth to a stillborn child after leaking amniotic fluid for eleven days. She brought an action against the Lee County Jail commander, the jail doctor, and the medical service provider, alleging that they had violated the Eighth Amendment through their deliberate indifference to her serious medical needs. Deliberate Indifference Alleged Regarding Treatment of Female Inmates in Labor in Arkansas: When Shawanna Nelson, a pregnant inmate in an Arkansas state prison, went into labor in September 2003, she was advised that the prison’s medical policy dictated that she could not be taken to the hospital until her contractions were no more than five minutes apart.
