Abstract: 

This article provides a comprehensive summary of the latest neurological findings about the processes of the brain that contribute to maladaptive behavior. It examines the neurological issues that are common to people involved in the criminal justice system, and reviews the emerging field of “neurolaw.” Most importantly, it proposes approaches to address the neurological needs of offenders in the criminal justice system. It is the contention of this author that the current practices in corrections actually aggravate the neurological issues afflicting persons in the criminal justice system and contribute to an increase in criminal behavior. Thus there needs to be a re-examination of correctional practices and the adoption of new approaches to the supervision and confinement of persons in the criminal justice system.
