Abstract:
In Darrah v. Krisher, 865 F.3d 361, the 6th Circuit ruled that the Ohio Department of Rehabilitation and Correction could be held negligent for ordering the use of a drug simply because it was on the state formulary and the proper drug was not, even though the formulary medication was known to be ineffective for the condition it was being prescribed for.Keywords: Prison Formularies
