Abstract:
In Jones v. Tex. Dep’t of Criminal Justice, the 5th Circuit Court of Appeals ruled that an inmate’s lawsuit against a Texas prison claiming that the facility, by refusing to provide a special diet, had caused the inmate to suffer a heart attack. While the court stopped short of validating the inmates claim that the prison caused his illness, it did rule that the facility had failed to accommodate legitimate and medically necessary dietary requirements In Estien v. Showalter, the 3rd Circuit Court ruled against an inmate who claimed that health staff at a Pennsylvania prison ignored repeated requests for medical care for injuries sustained in a fight with another inmate.Keywords: Diabetic Prisoners and Diet; PLRA’s exhaustion requirement
