Abstract: 

In Morris v. Livingston , 739 F.3d 740 (5th Cir. 2014), the court unequivocally upheld a Texas law requiring that a Texas prison inmate who initiates a visit to a health care provider must pay a health care service fee of $100. This article examines the court’s reasoning, and speculates on how the fee policy is likely to evolve in Texas and elsewhere.
