Abstract: 

In Elder v. Hockley County (Texas) Commissioners Court, 2014 WL 5315004 (5th Cir.), the court overturned the district court’s dismissal of plaintiff’s pro se complaint regarding excessive force and denial of medical care during his alcohol withdrawal. The 5th Circuit’s ruling against the Texas jail is an important reminder that while intoxication need not be considered a serious medical condition for purposes of constitutionally mandated treatment, withdrawal most certainly is, and requires medical care.
