Abstract:

Our regular review of important court decisions includes two federal appellate cases. In Kirk v. Maassen, 2022 WL 10225305, the 7th Circuit ruled against an inmate with a history of high blood pressure, multiple heart attacks, and congestive heart failure who claimed that the treatment decisions made by his physicians at Jackson Correctional Institution in Black River Falls Wisconsin were improper and not based on medical judgment. In Clark v. Coupe, 55 F.4th 167 (2022) the 3rd Circuit denied a qualified immunity defense for placement of a prisoner with serious mental illness in solitary confinement.
