Abstract:
The 9th Circuit denied defendant’s claim of qualified immunity in Atencio v Arpaio, and found sufficient likelihood that a jury could reach a verdict of excessive force in the custodial death of a mentally ill detainee. This article examines the facts in this case, the 9th Circuit’s finding, and what it discloses about the procedures and practices in place at the Maricopa County Jail under “America’s toughest sheriff.”Keywords: Qualified Immunity
