California Legislature Enacts Landmark But Controversial Bill Regarding the Issue of Consent in Campus Sexual Assault Cases

Abstract:
The California legislature recently enacted Senate Bill 967, which adds Section 67386 to the California Education Code. It is known informally as the “yes means yes” law (in reaction to the traditional “no means no”) and requires all California state colleges, community colleges, and governing boards of independent post-secondary institutions receiving state funds to adopt certain state-mandated policies regarding sexual assault, domestic violence, dating violence, and stalking (all of which are defined in the federal Higher Education Act of 1965, 20 U.S.C. Sec. 1992(f), including incidents occurring both on and off campus. This article examines the provisions of this new law and its likely impact, not only in California, but as a likley model for other states.Keywords: Affirmative consent standard
