Abstract: 

Milanca Lopez, an undergraduate student at the University of California, Berkeley and her six-year-old son were killed in a car accident, passengers in a car driven by Ms. Lopez’s boyfriend, Jose Lumbreras, who was under the influence of alcohol or narcotics at the time of the accident. The surviving family members brought a wrongful death action against Lumbreras, Berkeley, and a residential leasing manager at Berkeley alleging that Berkeley and the leasing agent were aware of harassment and abuse of Lopez by Lumbreras and failed to respond appropriately. While Berkeley prevailed on all issues raised in the case, notable was the university’s successful defense against an alleged Title IX complaint brought by the victim’s family: That successful defense is analyzed here. Also reviewed are decisions upholding a Temple University disciplinary action involving stalking; a decision upholding a lifetime ban from entering any athletic facility of the University of North Carolina imposed on a “fan” who had exhibited inappropriate behavior at events; and two disability suits, including a suit filed by a hearing impaired PhD candidate against the College of New England for failing to accommodate her disability.
