Abstract:

Mark Gizewski, now age 54, is severely disabled and also a prisoner in the New York corrections system. On January 31, 2014, counsel filed a complaint under the Americans with Disabilities Act (ADA) and Section 1983 alleging failure to accommodate his disabilities and cruel and unusual punishment under the Eighth Amendment. The Complaint serves up a host of horror stories that, if proved, present a powerful case of medical-security neglect.
