Abstract: 

Seven states and numerous offshore jurisdictions have statutes providing for some form of asset protection through the use of trusts. With the ever-present concern of lawsuits and ever rising insurance rates, interest in using such statutory provisions has grown significantly in recent years. Increasingly, individuals are looking to safeguard their assets not only from possible future creditors whose claims might exceed insurance ceilings, but also as a means of preserving personal wealth for the next generation.
