Abstract: 

On June 22, 2006, the United States Supreme Court held, in the case of Burlington Northern & Santa Fe Railway v. White (165 L. Ed. 2d 345) that the antiretaliation provision of Title VII (42 U.S.C.S. ยง 2000e-3) was not confined to actions and harms related to employment or occurring at the workplace so long as the employer actions were materially adverse to a reasonable employee or job applicant. This article will review that decision and then speculate as to how that decision may affect future Title IX cases brought by plaintiffs who have been allegedly subjected to retaliation.
