Family Court Shortcuts That Short Circuit Children’s Lives

Abstract:
A comprehensive examination of life-shortening harms posed by family court decisions that downplay or deny the seriousness of DV. The author proposes that such flawed court outcomes ignore the substantial body of DV literature and are based upon gender bias among court officials, and a triage mentality that prioritizes clearing court dockets rather than reaching just outcomes—.shortcuts used by the courts to save time and resources, to the severe detriment of the children involved. These shortcuts include coercing the most vulnerable party to settle the case, imposing shared parenting in cases of IPV, inadequately screening for DV, restricting the presentation of evidence of DV, and other measures that effectively deny justice and protection to child victims and their protective parent.Keywords: Kayden’s Law; “High Conflict” Model; Coerced Settlements and Shared Parenting
