Abstract:

For many attorneys, the opportunity to help clients engage in charitable giving is one of the most satisfying aspects of their legal practice. In performing such work, lawyers must keep in mind the ethical rules set forth by their state’s bar association to make sure that a charitable engagement does not run afoul of such rules. Because of the generally nonadversarial nature of planned giving, many potential ethical issues, especially with respect to conflicts of interest, may not be immediately obvious or intuitive in a charitable context.
