Abstract: 

A provision in a will or trust provides a bequest to a named foundation, but that foundation is not yet in existence. Is that a charitable bequest? The Georgia courts struggled with that issue in a recent case, Baker v. Merrill Lynch Trust Co., FSB (2007 Ga. App. LEXIS 754, 2007 Fulton County D. Rep. 2222 (July 5, 2007)).
